If you are an Arctis Design customer, employee, consultant, supplier or just visiting our website, this policy applies to you. If you are entering into a contract with Arctis Design or buying products or serviced from Arctis Design, you should also check the contract terms and conditions in addition to this Privacy Policy. The information we collate about you, or you provide to us is under legal basis as per data protection laws (including the GDPR). 

Arctis Design is responsible for making sure that any personal data is treated in accordance with applicable data protection laws. That includes informing you how companies (like us) collect and use data on your behalf.

Arctis Design is part of Arctis Ltd, a company registered in Scotland, with the company number SC616860 and registered address of 6 Laverock Road, Ellon, AB41 6FN.

If you are an Arctis Design customer or a visitor to our website we act as the ‘data controller’ of personal data entered within the contact form, account creation or payment processing. This means we determine how and why your data is processed. 

Arctis Design only processes personal data for:

  • Order fulfilment (to produce and ships orders that you have requested and paid for on our website or through other channels)
  • Accounts and records (including invoices, quotes, purchase orders and payments, including payments process via our website)
  • Advertising and marketing of products that may interest you (to existing customers or those who request contact via our website)
  • Staff administration (including payroll and HR)

 

Read this Privacy Policy! If you are our customer or supplier, please also check any contracts between us: they may contain further details on how we collect and process your data.

If you provide us with personal information about other people, or if others give us your information, we will only use that information for the specific reason for which it was provided to us. By submitting the information, you confirm that you have the right to authorise us to process it on your behalf in accordance with this Privacy Policy.

If you purchase products from our website or through other channels, we need to collect personal information about you to fulfil the order, such as your name, address and contact information. When you browse our website, we also automatically receive your computer’s internet
protocol (IP) address to provide us with information that helps us learn about your browser and operating system. This information is used to show you the website correctly depending on the device you are using, for example.

Email marketing: With your permission, we may send you emails about new products, services, discounts or coupons and other updates. You can unsubscribe or request for your information to removed from our database for this purpose at any time.

If you have a contract in place with Arctis Design, or have purchased products or services from Arctis Design, we act as the ‘data processor’. This means we only process your data to help us provide our service or product to you (our customer), or in accordance with your instructions, or as required by law.

Our online store is hosted by WordPress with WooCommerce. They provide us with the online e-commerce platform that allows us to sell our products and services to you.

Payments made on the Arctis Design website are processed externally using either Stripe or Paypal (as per your selection).

Your data is stored through the store host’s data storage, databases and the general store host’s application. They store your data on a secure server behind a firewall.

Similarly, if you have a contract in place with Arctis Design, or are supplying products or services to Arctis Design, we still act as the ‘data processor’. This means we only process your data to help you provide your service or product to us, or in accordance with your instructions, or as required by law. 

Contact details

Your name, address, telephone number, email address.

Financial information

Your bank account number, sort code, credit/debit card details. This is processed securely either through Stripe or Paypal.

Data that identifies you

Your IP address, login information, browser type and version, time zone setting, browser plug-in types, geolocation information about where you might be, operating system and version.

Data on how you use the Arctis Design website

Your URL clickstreams (the path you take through our site), products/services viewed, page response times, download errors, how long you stay on our pages, what you do on those pages, how often, and other actions. This is used to improve our website and services.

What about really sensitive data?

We don’t collect any “sensitive data” about you (like racial or ethnic origin, political opinions, religious/philosophical beliefs, trade union membership, genetic data, biometric data, health data, data about your sexual life or orientation, and offences or alleged offences) except when we have your specific consent, or when we have to comply with the law.

What about children’s data?

Arctis Design is a retail business directed to and intended for use only by those who are 18 years of age or over. We do not target Arctis Design at children, and we do not knowingly collect any personal data from any person under 16 years of age.

Consent

You have given clear consent for you to process your personal data for a specific purpose. When you provide us with personal information to complete a transaction, verify your credit card, place an order, arrange for a delivery or return a purchase, we imply that you consent to our collecting it and using it for that specific reason only. If we ask for your personal information for a secondary reason, like marketing, we will ask you directly for your expressed consent. Remember, you can change your mind! If you do withdraw your consent, and if we do not have another legal basis for processing your information, then we will stop processing your personal data. If we do have another legal basis for processing your information, then we may continue to do so subject to your legal rights.

Processing your data is necessary for a contract you have with us, or because we have asked you to take specific steps before entering that contract.

Legitimate interests

Processing your data is necessary for our legitimate interests or the legitimate interests of a third party, provided those interests are not outweighed by your rights and interests. These legitimate interests are:

  • Gaining insights from your behaviour on our website or in our app
  • Delivering, developing, and improving Arctis Design products and services
  • Enabling us to enhance, customise or modify our procedures and communications
  • Determining whether marketing campaigns are effective

You have the right to access information we hold about you

  • The categories of third parties to whom the data may be disclosed

We will provide you with the information within one month of your request, unless doing so would adversely affect the rights and freedoms of others (e.g. another person’s confidentiality or intellectual property rights). We will tell you if we can’t meet your request for that reason.

You have the right to make us correct any inaccurate personal data about you

If you notice that we hold inaccurate or out of date personal information about you, then you have the right to request that this is updated and corrected. You can do so in your account page on our website or by contacting us through our Contact Form.

You can object to us using your data for profiling you or making automated decisions about you

We may use your data to determine whether we should let you know information that might be relevant to you (for example, tailoring emails to you based on your behaviour). Otherwise, the only circumstances in which we will do this is to provide Arctis Design services to you.

You have the right to port your data to another service

If requested, we will give you a copy of your data in CSV or JSON so that you can provide it to another service. We will endeavour to help you in this process wherever possible. However, we will not do so to the extent that this involves disclosing data about any other individual.

You have the right to be ‘forgotten’ by us

You can do this by asking us to erase any personal data we hold about you if it is no longer necessary for us to hold the data for purposes of your use of Arctis Design. You may request the deletion of data by reaching out to us via our Contact Form.

You have the right to lodge a complaint regarding our use of your data

Please tell us first, so we have a chance to address your concerns! However, if we fail in this, you can address any complaint to the UK Information Commissioner’s Office, either by calling their helpline or as directed on their website at www.ico.org.uk.

On the other side of a contract? You have rights too!

If you have signed a contract through Arctis Design and you wish to exercise your rights, please contact the relevant Arctis Design user. If you prefer, you can contact us using our Contact Form. We will pass the request on to our user (please provide their name and, if possible, email address). Please include any relevant information about the contract in the contact form so that we can deal with the request appropriately.
